These Platform Terms of Use ("Platform Terms") apply to any individual who accesses or uses the Fig Platform, the Fig Endpoint Agent, the Fig Cloud Agent, the Fig Data Scanner or the Fig Vulnerability Scanner (together, the "Fig Services"), whether as an employee, contractor or other authorised user of an MSP or of an End Customer (an "Authorised User").
If your organisation has signed an MSP Order Form or Order Form with Fig Technology Limited ("Fig", "we", "us"), that Order Form and the Master Subscription Agreement (and, where applicable, the MSP Partner Agreement) govern the relationship between Fig and your organisation. These Platform Terms are a separate, direct agreement between you personally (and, where you have authority to bind your organisation, your organisation) and Fig, governing your individual access to the Fig Platform.
1. Acceptance
You must accept these Platform Terms before you first access the Fig Services, and again whenever we update them in a way we consider material. Continued use of the Fig Services after an update means you accept the update. If you don't agree, don't use the Fig Services - contact your organisation's Fig administrator.
2. What these terms don't do
These Platform Terms don't increase, dilute or replace any commitment Fig has given your organisation under a Master Subscription Agreement or MSP Partner Agreement. If there's a conflict between these Platform Terms and that agreement on a matter the agreement covers, the agreement wins as between Fig and your organisation. These Platform Terms govern your personal use of the platform as an individual.
3. Your access
- You'll be given a login (or single sign-on access) by your organisation's Fig administrator. Keep your credentials confidential and don't share your account with anyone else.
- Tell us or your administrator promptly if you suspect unauthorised access to your account.
- Your access level (Regular User or Occasional User) is set by your organisation and determines what you can see and do in the platform.
4. Acceptable use
When using the Fig Services, you must not:
- try to access data, tenants, or End-Customer environments you're not authorised to see;
- attempt to probe, scan, or test the security of the Fig Services, or bypass any security control, without Fig's prior written authorisation;
- reverse engineer, decompile or attempt to extract the source code of the Fig Services;
- upload malware, or use the Fig Services to attack, scan or monitor any system you (or your organisation) aren't authorised to test - this includes strict compliance with the authorisation requirements that apply to the Fig Vulnerability Scanner, described in our Product-Specific Terms;
- remove or obscure any Fig branding or proprietary notices; or
- use the Fig Services for anything unlawful or that infringes someone else's rights.
We may suspend your access immediately, without notice, if we reasonably believe you've breached this section or that continued access poses a security or legal risk.
5. Ownership and feedback
Fig (and its licensors) own the Fig Services, the Fig Software, the Documentation and all output the platform generates. Nothing here transfers any of that to you. If you send us feedback, ideas or suggestions about the Fig Services, you agree we can use them freely, without any obligation to you.
6. No professional advice
The Fig Services are tools that help you run a compliance, security or risk-management programme. They're not legal advice, an audit opinion, or a certification, and using them doesn't by itself make you (or your organisation) compliant with any law, standard or framework. Decisions based on anything the platform tells you remain your organisation's responsibility.
7. Termination of your access
Your access ends automatically when your organisation removes you as an Authorised User, or when the underlying subscription between Fig and your organisation ends. We may also suspend or end your individual access for breach of these Platform Terms.
8. Changes to these terms
We may update these Platform Terms from time to time, on reasonable notice through the Fig Platform. We won't use an update to these Platform Terms to reduce any commitment Fig owes your organisation under its Master Subscription Agreement.
9. Governing law
These Platform Terms are governed by the law of England and Wales, and the English courts have exclusive jurisdiction over any dispute arising from them.
